The Allen Acres Wastewater Treatment Facility is a domestic wastewater treatment facility located at 143 McIntosh Hill Road in Foley, Missouri. Domestic wastewater facilities receive wastewater from residential homes, businesses and sometimes industrial sources. The facilities are designed to remove pollutants and other contaminants from the wastewater before discharging the treated water back into the environment. The Allen Acres Wastewater Treatment Facility discharges to an unclassified stream that flows approximately 0.3 miles to Mallard Lake.
On June 26, 2024, a fish kill was reported in Mallard Lake. The Missouri Department of Conservation investigated the reported fish kill. The Missouri Department of Natural Resources performed inspections at the Allen Acres Wastewater Treatment Facility on July 19, 2024, July 24, 2024, and Aug. 5, 2024. The Department of Natural Resources issued a referral notice of violation to the facility on Aug. 30, 2024, which included numerous corrective actions.

In August 2024, Allen J. Ivy submitted a permit application to renew the facility's National Pollutant Discharge Elimination System (NPDES) permit, which allows them to discharge to waters of the state. On March 14, 2025, the Department of Natural Resources invited the public to review and offer written comments on the proposed permit conditions. During the public comment period, the department received numerous comments concerning the discharge from the facility and the water quality of Mallard Lake, and requests to hold a public hearing.

On May 19 and 20, 2025, the department sampled the Allen Acres Wastewater Treatment Facility discharge and representative points of Mallard Lake. The facility completed all required corrective actions associated with the Aug. 30, 2024, referral notice of violation. On July 29, 2025, the department’s Compliance and Enforcement Section concluded its enforcement action.
