An antidegradation review request was submitted by New Florence Owner LLC to evaluate a proposed new domestic wastewater discharge, Project Green , which includes a new Amazon Web Services data center facility. The department proposes to make a preliminary antidegradation determination for the project, subject to certain effluent limitations, schedules and special conditions. The department invites the public to review and offer written comments on the proposed antidegradation determination until Aug. 3, 2026. All comments must be received or postmarked by 5 p.m. The public can review the proposed preliminary determinations below. Other relevant information is available for review and copying upon request.

Written comments may be submitted by mail to Missouri Department of Natural Resources, Water Protection Program, ATTN: Engineering Section/ Antidegradation Comments, P.O. Box 176, Jefferson City, MO 65102-0176 or by email to publicnoticenpdes@dnr.mo.gov. Please identify the project in all comment letters or emails. The department can only consider comments about issues relating to the preliminary determination and its effect on water quality. The department cannot consider comments or objections to a preliminary determination based on issues outside the authority of the Missouri Clean Water Commission (see Curdt v. Mo. Clean Water Commission, 586 S.W.2d 58 Mo. App. 1979). An operating permit implementing the preliminary antidegradation determinations will be public noticed at a later date, providing further opportunity for comments.

The proposed project is consistent with the "Missouri Antidegradation Implementation Procedure, July 13, 2016" and meets the applicable requirements. The proposed preliminary determinations are tentative pending public comment. The department will consider all written comments, including emails, faxes and letters, in the formulation of all final determinations regarding the submittal. If response to this notice indicates there is significant public interest, the department may hold a public meeting or public hearing, after due public notice. Public hearings and finalizing determinations are conducted or processed according to 10 CSR 20-6.020.
